1. Agreement to Terms

MapEdit is a free, browser-based map editing tool available at mapedit.net (the "Service"), operated by an individual ("the Operator," "we," "us," or "our"). By accessing or using the Service, you ("you" or "User") agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Service.

2. The Service

MapEdit is a browser-based geographic information system (GIS) tool that lets you create, edit, analyze, and share maps. It includes drawing tools, layer management, spatial analysis, data import/export, route planning, and map sharing.

The Service is provided free of charge as a personal project. It is not a commercial product backed by a company, support team, or service-level agreement. We may modify, suspend, or discontinue the Service at any time, for any reason, without notice.

3. Eligibility

You must be at least 13 years old to use the Service. If you are using the Service on behalf of an organization, you represent that you have the authority to agree to these Terms on its behalf.

4. Accounts

Some features require an account. You are responsible for keeping your credentials secure and for all activity under your account. If you believe your account has been compromised, contact us immediately. We may suspend or delete accounts that violate these Terms.

5. Your Content

You retain ownership of all maps, data, and content you create or upload ("User Content"). We do not claim ownership of your User Content.

By using the Service, you grant us a limited, non-exclusive license to host, store, display, and transmit your User Content solely to operate the Service (e.g., rendering your maps, making shared maps accessible to your recipients). This license ends when you delete your content or account.

You are solely responsible for your User Content. You represent that you have the rights to use it, that it does not violate any law, and that it does not infringe anyone else's rights.

6. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose.
Upload content that is illegal, defamatory, threatening, or otherwise harmful.
Attempt to gain unauthorized access to other accounts or to the Service's infrastructure.
Interfere with or disrupt the Service, including through automated scripts, bots, or scrapers.
Circumvent rate limiting, access controls, or other security features.
Use geospatial data from the Service for military targeting, mass surveillance, or activities that violate human rights.
Resell or redistribute access to the Service.

7. Map Sharing

When you share a map, you control the access level (public, email-restricted, or password-protected). You are solely responsible for your sharing choices. Once a map is shared publicly, anyone with the link can view it. We are not responsible for the consequences of your sharing decisions.

8. Third-Party Services

The Service uses third-party mapping, geocoding, and routing providers including OpenStreetMap, MapTiler, Apple MapKit JS, Nominatim, and OSRM. These services have their own terms and privacy policies. We have no control over their availability, accuracy, or data practices. OpenStreetMap data is provided under the Open Data Commons Open Database License (ODbL).

9. Open-Source Components

The Service is built with open-source software, each component governed by its own license. A full list is available on our Acknowledgements page. Nothing in these Terms restricts your rights under those open-source licenses.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE AVAILABLE, UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THAT ANY DATA YOU STORE IN THE SERVICE WILL BE PRESERVED, BACKED UP, OR RECOVERABLE.

GEOSPATIAL DATA, MEASUREMENTS, DISTANCES, AREAS, ROUTING DIRECTIONS, AND ANALYSIS RESULTS PROVIDED BY THE SERVICE ARE APPROXIMATE AND FOR GENERAL INFORMATIONAL PURPOSES ONLY. THEY MUST NOT BE RELIED UPON FOR NAVIGATION, LAND SURVEYING, LEGAL BOUNDARY DETERMINATION, EMERGENCY RESPONSE, ENGINEERING, CONSTRUCTION, OR ANY PURPOSE WHERE INACCURACY COULD RESULT IN PROPERTY DAMAGE, FINANCIAL LOSS, PERSONAL INJURY, OR DEATH. ALWAYS VERIFY CRITICAL GEOSPATIAL INFORMATION WITH QUALIFIED PROFESSIONALS AND AUTHORITATIVE SOURCES.

11. Assumption of Risk

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE OPERATOR IS AN INDIVIDUAL PROVIDING THIS SERVICE FREE OF CHARGE AS A PERSONAL PROJECT. YOU ASSUME ALL RISK ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO THE RISK OF DATA LOSS, INACCURATE RESULTS, SERVICE INTERRUPTIONS, AND SECURITY BREACHES.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE OPERATOR SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, NOR FOR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF (OR INABILITY TO USE) THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE), EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

BECAUSE THE SERVICE IS PROVIDED FREE OF CHARGE, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED ZERO DOLLARS ($0.00 USD).

13. Indemnification

You agree to indemnify, defend, and hold harmless the Operator from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any law or any rights of a third party.

14. Termination

We may suspend or terminate your access to the Service at any time, for any reason, without notice. You may stop using the Service or delete your account at any time. Upon termination, your right to use the Service ceases immediately. Sections 5 (Your Content, license grant), 10-13, 15, and 16 survive termination.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict-of-law provisions. Any dispute arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Texas. You consent to personal jurisdiction and venue in such courts and waive any objection thereto. To the extent permitted by law, you waive any right to a jury trial.

16. General

Entire agreement: These Terms and the Privacy Policy constitute the entire agreement between you and the Operator regarding the Service.
Severability: If any provision is held invalid or unenforceable, the remaining provisions continue in full force.
Waiver: Our failure to enforce any provision does not waive our right to enforce it later.
Assignment: You may not assign your rights under these Terms. We may assign ours without restriction.
No third-party beneficiaries: These Terms do not create rights for anyone other than you and us.
Force majeure: We are not liable for failures caused by events beyond our reasonable control.

17. Changes to These Terms

We may update these Terms at any time. Changes take effect when posted. The "Last updated" date at the top reflects the most recent revision. Your continued use of the Service after changes are posted constitutes acceptance.
